CONSUMER PROTECTION

Most of us have signed a contract without understanding the contents entirely. In such instances, we would first assume that nothing can be done if for example we wanted to terminate the contract or vary the terms of the contract.

Fortunately, in Australia as consumers, we are protected by various laws that protect innocent parties in various circumstances such as in times where one party misled the other, possibly deceived the other, or maybe acted unconscionably.

In other more serious instances of misleading and deceptive conduct that has gone above and beyond "simple wrongs", such cases may be considered fraudulent activity.

We are able to assist you with very complicated cases of fraud which may require commencing an action in the relevant court at a State or Federal level to get back what was lost.

HOW WE CAN HELP:

  • We are able to advise you on your rights when you feel that you have been victim to misleading and deceptive conduct or unconscionable conduct.

  • We are able to assist you with defending a claim for misleading and deceptive conduct or unconscionable conduct.

  • For allegations of fraud, we are able to assist you with communicating to the relevant authorities, assist you by commencing an action for return of fraudulently acquired assets, goods or monies.

  • We are able to assist you by drafting essential consumer contracts such as an agreement to sell goods or supply a service, a small business contract and so on.

  • If you intend on engaging in credit activities, we can assist you through applying for a credit licence.

  • We are able to assist you with providing full and frank disclosure if you are considering entering into a credit contract.

Some things you should keep in mind when entering into contracts:

  • What are the terms of the contract?

  • Do I have capacity to enter into the contract?

  • Is the contract fair?

  • What is the life of the contract?

  • What happens if I breach the contract?

  • What happens if I change my mind after I sign the contract?

If you feel that you have entered into a contract under false pretenses, need help with credit licences or full and frank disclosures, please email us at info@bmslaw.com.au or call us (08)63890270
